Terms of Service ForceVPS

These Terms of Service («ToS») are the primary document governing the use of ForceVPS services.
The following documents form an integral part of these Terms of Service and shall be read together with them:
- Privacy Policy;
- Cookie Policy;
- Acceptable Use Policy (AUP);
- Refund Policy;
- Service Level Agreement (SLA);
- Abuse Policy;
- Data Processing Agreement (DPA).
By placing an order, paying for services, or using ForceVPS services, the Client confirms their agreement with all of the above documents.
In the event of any conflict between these Terms of Service and other ForceVPS documents, the provisions of these Terms of Service shall prevail unless expressly stated otherwise in the relevant document.
1. General Provisions
These Terms of Service («Terms of Service», «ToS», «Agreement») govern the use of the ForceVPS website, client area, billing system, and all services provided under the ForceVPS brand.
By placing an order, paying for services, or using ForceVPS services, the Client confirms their agreement with these Terms.
If the Client does not agree to these Terms, they must discontinue use of the services.
2. Service Provider Information

Hereinafter referred to as «ForceVPS», «Company», «we», «us», «our».
3. Definitions
Client — an individual or legal entity that uses ForceVPS services.
Services — any products and services provided by ForceVPS, including:
- VPS/VDS;
- Dedicated Servers;
- Colocation;
- IPv4 and IPv6 addresses;
- licenses;
- backups;
- network services;
- additional services.
Account — the Client’s account in the ForceVPS billing system.
Abuse complaint — any report of a violation of law, network usage rules, or these Terms.
4. Right to Use Services
The Client confirms that they:
- are at least 18 years of age;
- have the legal capacity to enter into binding agreements;
- provide accurate information;
- do not use the services in violation of applicable law.
ForceVPS reserves the right to refuse to provide services without stating reasons.
5. Account Registration
The Client must:
- provide current and accurate information;
- keep such information up to date;
- maintain the confidentiality of their password;
- immediately notify ForceVPS of any account compromise.
The Client is fully responsible for all actions performed through their account.
6. Provision of Services
Services are deemed provided from the moment of their activation.
ForceVPS reserves the right to:
- change technical parameters of services;
- upgrade infrastructure;
- perform scheduled maintenance;
- replace equipment;
- modify network architecture.
Such changes shall not be considered a breach of the Agreement unless they result in a material degradation of the service.
7. Pricing and Payment
All services are provided on a prepaid basis.
The Client must pay for services before the renewal date.
ForceVPS reserves the right to:
- change prices for future billing periods;
- modify pricing plans;
- discontinue certain services.
New pricing does not apply to an already paid period.
All bank, payment system, and intermediary fees are paid by the Client.
8. Late Payment
If payment is not received, ForceVPS reserves the right to:
- restrict access to the service;
- suspend server operation;
- delete the service after the data retention period expires.
ForceVPS is not liable for data loss after service deletion due to non-payment.
9. Refunds
Refunds are governed by a separate Refund Policy.
Unless otherwise expressly stated:
- domains are non-refundable;
- licenses are non-refundable;
- IPv4 addresses are non-refundable;
- rendered services are non-refundable.
Payment system fees may be deducted from the refund amount.
10. Order Verification and Anti-Fraud
ForceVPS reserves the right to conduct automatic and manual order verification.
We may request:
- identity document;
- proof of address;
- proof of payment method ownership;
- additional information.
If the Client refuses verification, the Company may refuse service or cancel the order.
11. Use of Services
The Client must use the services lawfully.
Use of the services is prohibited for:
- distributing malicious software;
- phishing;
- carding;
- fraud;
- unauthorized access;
- DDoS attacks;
- botnets;
- mass spam distribution;
- distributing illegal content;
- copyright infringement;
- any other unlawful activity.
12. Abuse and Violations
Upon receiving a complaint, ForceVPS reserves the right to:
- request an explanation;
- temporarily restrict service operation;
- block individual services;
- fully disconnect the server.
In case of a serious threat to infrastructure, blocking may be performed without prior notice.
13. Sanctions Restrictions
ForceVPS reserves the right to refuse service to:
- individuals and organizations subject to sanctions;
- persons from prohibited jurisdictions;
- users whose activities may result in a violation of sanctions law.
14. IPv4 and IPv6 Addresses
All IP addresses remain the property of ForceVPS or the relevant internet registry.
The Client receives a limited right to use IP addresses only for the duration of the service.
ForceVPS reserves the right to:
- change assigned IP addresses;
- revoke IP addresses;
- require justification for address space usage.
15. Backups
Unless a backup service is purchased separately, the Client is solely responsible for creating backups of their data.
ForceVPS does not guarantee the ability to recover data after deletion, damage, or compromise.
16. Technical Support
Technical support is provided within the scope of the purchased service.
ForceVPS is not obligated to:
- administer the Client’s software;
- fix user code errors;
- perform work unrelated to infrastructure.
17. Service Availability
ForceVPS strives to maintain a high level of service availability.
Availability metrics are defined in a separate SLA document.
Scheduled maintenance is not considered downtime.
18. Limitation of Liability
ForceVPS is not liable for:
- loss of profit;
- loss of data;
- indirect damages;
- actions of third parties;
- Internet network outages;
- actions of data centers;
- errors in the Client’s software.
ForceVPS’s maximum liability is limited to the amount actually paid by the Client for the relevant service during the last 30 calendar days.
19. Indemnification
The Client agrees to indemnify and hold harmless ForceVPS, its employees, officers, contractors, partners, and service providers from any damages, expenses, fines, claims, lawsuits, court costs, legal fees, and other liabilities arising from:
- the Client’s breach of these Terms of Service, the Acceptable Use Policy (AUP), or other ForceVPS documents;
- use of the services in violation of applicable law;
- infringement of third-party rights, including intellectual property rights;
- distribution of malware, spam, phishing materials, fraudulent content, or other prohibited content;
- actions or inaction by the Client that result in claims, lawsuits, investigations, or sanctions against ForceVPS.
ForceVPS reserves the right to take measures to protect its interests and require the Client to compensate incurred costs to the extent permitted by applicable law.
20. Force Majeure
ForceVPS is not liable for failure to perform obligations due to force majeure circumstances, including:
- war or military actions;
- terrorist acts;
- cyberattacks;
- natural disasters;
- power outages;
- actions of government authorities;
- telecommunications infrastructure failures.
21. Termination of Service
The Client may discontinue use of the services at any time.
ForceVPS may terminate service in case of:
- breach of these Terms (ToS);
- breach of the AUP;
- non-payment;
- provision of false information;
- creation of a threat to infrastructure or other clients.
22. Changes to Terms
ForceVPS reserves the right to amend these Terms at any time.
The new version takes effect upon publication on the website.
Continued use of the services constitutes the Client’s acceptance of the updated terms.
23. Governing Law
This Agreement is governed by the laws of Ukraine.
Disputes shall be resolved in accordance with the laws of Ukraine.
