ForceVPS Acceptable Use Policy (AUP)

1. General Provisions
This Acceptable Use Policy ("AUP", "Policy") establishes the rules governing the use of ForceVPS services.
This Policy forms an integral part of the Terms of Service (ToS) and applies to all services provided by ForceVPS, including:
- VPS/VDS;
- Dedicated Servers;
- Colocation;
- IPv4 and IPv6 addresses;
- Network services;
- Additional products and services.
By using ForceVPS services, the Customer agrees to comply with this Policy.
2. General Obligations of the Customer
The Customer is required to:
- comply with applicable laws and regulations;
- respect the rights of third parties;
- refrain from using the services for unlawful activities;
- avoid creating threats to the ForceVPS infrastructure or other customers;
- respond to notifications from ForceVPS in a timely manner.
The Customer bears full responsibility for all activities conducted through their services.
3. Prohibited Activities
The use of ForceVPS services for the following activities is strictly prohibited:
3.1 Malicious Software
- distribution of viruses;
- trojans;
- ransomware;
- spyware;
- rootkits;
- malicious code;
- any other forms of malware.
3.2 Phishing and Fraud
- creation of phishing websites;
- unauthorized credential harvesting;
- forgery of payment pages;
- fraudulent schemes;
- financial fraud;
- carding activities.
3.3 Unauthorized Access
- hacking of computer systems;
- unauthorized data access;
- password cracking (brute force attacks);
- unauthorized vulnerability scanning;
- exploitation of system vulnerabilities.
3.4 Network Attacks
- organization and execution of DDoS/DoS attacks;
- participation in botnets;
- spoofing activities;
- any other actions disrupting third-party networks.
3.5 Spam and Bulk Mailing
- sending unsolicited electronic messages (SPAM);
- bulk mailing without the explicit consent of recipients;
- hosting links to spam resources;
- utilizing open relays for mailing purposes.
3.6 Illegal Content
- hosting materials that infringe upon copyrights or intellectual property;
- distribution of child pornography;
- promotion of violence, terrorism, or extremism;
- hosting hate speech or discriminatory content;
- any other content prohibited by applicable law.
4. Resources and Server Load
The Customer agrees not to abuse ForceVPS system resources.
It is prohibited to:
- generate excessive, continuous CPU load;
- cause severe disk subsystem overhead (I/O usage);
- create abnormally high network traffic that disrupts channel capacity;
- use the services in a manner that degrades service quality for other customers.
5. Specific Activities (Mining, Tor, etc.)
On VPS/VDS services, it is strictly prohibited to:
- mine cryptocurrencies (e.g., Chia, Bitcoin, Monero);
- operate Tor nodes (especially Exit Nodes);
- run game servers (unless explicitly permitted);
- perform unauthorized port scanning.
For Dedicated Servers and Colocation, these activities may be permitted subject to prior written approval from ForceVPS.
6. Security and Passwords
The Customer is obligated to maintain the security of their software environment.
The Customer must:
- use strong, secure passwords;
- keep the operating system and applications updated;
- patch software vulnerabilities in a timely manner;
- prevent server compromise and unauthorized access.
7. IPv4 and IPv6 Address Policy
It is prohibited to:
- use unassigned IP addresses;
- cause IP addresses to be listed in blacklists (e.g., Spamhaus, Barracuda);
- use IP resources to conceal unlawful activities.
If an IP address is blacklisted due to the Customer's actions, ForceVPS reserves the right to demand compensation for costs incurred to delist the address.
8. Monitoring and Detection of Violations
ForceVPS does not actively monitor Customer data.
However, the Company reserves the right to conduct investigations if:
- Abuse reports are received;
- Abnormal network activity is detected;
- Hacking or server compromise is suspected.
9. Handling Abuse Reports
Upon receiving an Abuse report, ForceVPS forwards it to the Customer.
The Customer must:
- provide a response within the designated timeframe (typically 24 hours);
- resolve the underlying cause of the complaint;
- notify ForceVPS of the corrective actions taken.
10. Penalties for AUP Violations
In the event of a violation of this Policy, ForceVPS may:
- issue a formal warning;
- rate-limit network speeds;
- block specific ports or IP addresses;
- suspend services (Suspension);
- terminate services without a refund (Termination).
11. Actions Without Prior Notice
ForceVPS reserves the right to suspend services without prior notice if the Customer's activities:
- pose a critical threat to infrastructure security;
- originate active DDoS attacks;
- violate applicable laws;
- risk causing financial or legal liability for ForceVPS.
12. Emergency Suspension
ForceVPS reserves the right to immediately suspend or terminate Services without prior notice where Customer activities:
- threaten infrastructure security;
- violate applicable laws;
- create risks for other customers;
- may result in sanctions, penalties, or enforcement actions by data centers, carriers, or government authorities.
13. Sanctions Compliance
Use of Services in violation of sanctions laws is prohibited.
ForceVPS reserves the right to refuse, suspend, or terminate Services provided to sanctioned persons, entities, or jurisdictions.
14. Violations of this Policy
In the event of a violation of this AUP, ForceVPS may:
- issue a warning;
- restrict access to Services;
- temporarily suspend Services;
- remove content;
- terminate Services;
- refuse future service requests.
Enforcement actions shall be determined at the sole discretion of ForceVPS based on the severity of the violation.
15. Amendments and Updates
ForceVPS reserves the right to modify this Policy at any time.
The current version shall be published on the website and shall become effective upon publication.
Continued use of the Services constitutes acceptance of the updated Policy.
